1. Scope and application of these general terms and conditions
1.1. TourBookers GmbH, Zielstattstr. 19, 81379 Munich (hereinafter referred to as "TourBookers GmbH") operates an intermediary online platform (hereinafter referred to as the "TourBookers Platform") tourbookers.com. This platform is available over the internet and lists guided and unguided tours, activities and experiences such as sightseeing and adventure tours, sports and nature activities, cultural and romantic experiences, boat trips, cooking classes, wellness treatments as well as admission tickets for sights and other services, for example rentals and transfers (hereinafter referred to collectively as the "Tour").
1.2. The Tours are offered and put online by a number of independent local providers (hereinafter referred to as "Tour Providers"). Contracts for Tours are concluded directly between the user of the TourBookers Platform (the "User") and the Tour Provider for Tours. Additional terms and conditions of the Tour Provider may apply to the provision of the Tours. The User receives these additional terms and conditions ("What you should know beforehand") in the description of the Tour on the TourBookers Platform and at the latest after confirmation of the Tour booking. If a User books Tours via a linked partner platform, or if a sub-intermediary makes a Tour booking on behalf of a User on an affiliated partner platform, a corresponding contract is concluded directly between that User and the Tour Provider. TourBookers GmbH is not a party to any contract in respect of the Tours offered on the TourBookers Platform.
1.3. The contractual relationship between the User and TourBookers GmbH comprises solely the proper referral of the User by TourBookers GmbH to the respective Tour Provider, or the forwarding of information from the Tour Provider to the User. In respect of the Tour, TourBookers GmbH does not act as organiser, lessor, seller or any other contracting party. TourBookers GmbH gives no guarantee or warranty for the Tours provided by the Tour Providers. The User's point of contact for questions and claims in connection with a tourist service contract and its performance is exclusively the respective Tour Provider.
1.4. TourBookers GmbH also makes the TourBookers Platform available to certain cooperation partners (sub-agents/distribution partners) for booking the Tour Provider's Tours. Use of the TourBookers Platform by sub-agents or distribution partners requires a separate contractual agreement and is not permitted without the prior written consent of TourBookers GmbH.
1.5. These general terms and conditions apply to every use of the TourBookers Platform, including but not limited to bookings of Tours via the TourBookers Platform.
1.6. TourBookers GmbH may prevent Users from accessing the TourBookers Platform or parts of it, or make such access subject to certain conditions.
2. Information available on the TourBookers Platform
2.1. The information on the TourBookers Platform is provided for general information purposes only. Information on the TourBookers Platform does not constitute a binding offer by TourBookers GmbH. Binding agreements with Tour Providers of Tours available on the TourBookers Platform require a Tour booking request via the TourBookers Platform and the confirmation of the Tour booking request by the Tour Provider in accordance with these general terms and conditions of TourBookers GmbH.
2.2. While TourBookers GmbH endeavours to ensure that the information available on or via the TourBookers Platform is correct, it gives no express or implied warranties as to its accuracy, completeness, timeliness, reliability, fitness for a purpose or otherwise (including for information from third parties). TourBookers GmbH may at any time and at its own discretion change, add or remove information on the TourBookers Platform as well as its structure and functions, without expressly informing anyone of such changes and without removing outdated information or marking it as such.
3. Registration, cancellation of the registration
3.1. In order to make or change a Tour booking on the TourBookers Platform, the User must be registered. Registration takes place during the booking process, in which the User agrees to the general terms and conditions of TourBookers GmbH and a user account is created. Natural persons must be over 18 years of age in order to register. The Tour may only be booked by natural persons.
3.2. The creation of more than one user account for the same natural person or legal entity is not permitted. The user account cannot be transferred. The User shall keep the registration data (login name and password) secret, take suitable precautions to prevent third parties from learning of them, and not allow third parties to access the TourBookers Platform using their registration data. The User is responsible for any use of their user account on the TourBookers Platform.
3.3. The User may cancel their registration on the TourBookers Platform at any time by contacting TourBookers customer service at info@tourbookers.com. TourBookers GmbH may cancel a registration unilaterally giving one week's notice. The right to extraordinary cancellation remains unaffected. Claims that arose before the termination, as well as agreements for Tours between the User and the Tour Provider, remain unaffected by the termination of the user account.
4. Booking of Tours, conclusion of contract, cancellation and change of Tours
4.1. The User selects the desired Tours on the TourBookers Platform. By clicking on one of the Tours offered, the User receives information about the Tour, including for example the Tour Provider, the duration and the price as well as, where applicable, the terms and conditions of the Tour Provider ("What you should know beforehand") for the provision of the Tour. The User is responsible for meeting and complying with these conditions. The Tour Provider may reserve the right to exclude the User from individual activities or from the Tour itself if the User does not comply with the Tour Provider's terms and conditions. In this case the Tour Provider may reserve the right not to refund the price paid.
4.2. The User enters the specifications of the desired Tour (for example desired date, start time, number of participants). After selecting the Tour and passing it to the shopping cart by clicking "Add tour to cart", the User can leave additional information that may be required for the pick-up (for example name and address of the hotel, message to the Tour Provider). In the next step the User enters their customer data as billing information (for example first name, last name, country (place of residence), mobile number) and reaches the checkout by clicking the "Continue to checkout" button. In the checkout area the User selects their preferred payment method and agrees to the general terms and conditions. By clicking the "Order now with an obligation to pay and continue to payment" button, the User is forwarded from the TourBookers Platform to the PayPal store page. By clicking the "Continue" button, the User makes a binding contractual offer to the Tour Provider for the desired tourist service.
4.3. TourBookers GmbH provides the User with a Tour booking request confirmation by email. The User is bound by their contractual offer for seven days. If the Tour Provider confirms the offer within this period, the contract is concluded and binding.
4.4. The Tour Provider will as a rule confirm or reject the Tour booking request to TourBookers GmbH within seven days. If the Tour Provider confirms the User's Tour booking request, the contract for the selected Tour is concluded directly between the User and the Tour Provider. On behalf of the Tour Provider, TourBookers GmbH sends the User a booking confirmation by email with the partly paid voucher (hereinafter referred to as the "Partly Paid Voucher") for the security retention (hereinafter referred to as the "Security Deposit", see 5.4), with the terms and conditions of the Tour Provider and the invoice for the Security Deposit. If the Tour Provider rejects the User's Tour booking request, TourBookers GmbH informs the User accordingly.
4.5. TourBookers GmbH forwards to the User all data on the use of the Tour Provider's Tour in accordance with the applicable conditions as soon as it has been received from the Tour Provider. TourBookers GmbH gives no guarantee for the accuracy of the forwarded data or for the provision of the Tours by the Tour Provider.
4.6. The User can manage their Tour bookings on the TourBookers Platform under "My tours". The "My tours" dashboard contains all relevant information about the Tour (for example details of the Tour Provider, Tour data, booking data) and offers the option of downloading the Partly Paid Voucher and cancelling the Tour booking.
4.7. The User can cancel their booking of the Tour on the TourBookers Platform under "My tours" by clicking the button "Cancel tour booking request free of charge" (if the Tour Provider has not yet confirmed the Tour booking request), "Cancel tour booking free of charge" (if the Tour Provider has already confirmed the Tour booking request and the User cancels within the stated cancellation period) or "Cancel tour booking (for a fee)" (if the Tour Provider has already confirmed the Tour booking request and the User cancels outside the stated cancellation period). In these cases TourBookers GmbH sends the User a cancellation confirmation by email.
4.8. The Tour Provider may change or cancel the Tour up to and on the agreed date without observing a notice period if weather conditions, official measures, strikes or other unforeseeable or unavoidable external conditions (in particular force majeure) make the performance of the Tour impossible, more difficult or hazardous. In the event of a change, the Tour takes place and the Tour Provider offers a comparable Tour programme. In the event of a cancellation of the Tour by the Tour Provider, the Tour does not take place and TourBookers GmbH sends the User a cancellation confirmation by email.
4.9. After a booking that was carried out and not cancelled, the User can review the Tour once (stars and text). The review is shown publicly on the Tour's page with the User's first name and country; the Tour Provider can reply to it. TourBookers GmbH may hide reviews that break applicable law or these terms.
5. Prices and payments
5.1. All special offers and promotional campaigns are marked as such.
5.2. All prices on the TourBookers Platform are stated per person or group and include value added tax and all other applicable national, governmental, regional, state, municipal or local taxes or levies. No further levies, taxes, fees, commissions or other costs are demanded from the User when the Tour is carried out.
5.3. The prices are set by the Tour Providers and may be subject to special conditions, for example regarding cancellation and refund of payments made. Please check carefully before booking the Tour whether separate conditions apply to the respective Tour.
5.4. The payment of the Tour price for the Tour is summarised for the User in the checkout area of the TourBookers Platform and comprises the following payments: the payment designated as "Due now (Security Deposit incl. VAT)" is charged by TourBookers GmbH after the Tour Provider has confirmed the Tour booking request and secures the reservation of the Tour for the User. The Security Deposit amounts to approximately 20% of the Tour price. TourBookers GmbH issues an invoice for this payment, which is included in the booking confirmation email to the User. The remaining amount "Due on the day of your tour" (approximately 80% of the Tour price) is to be paid by the User to the Tour Provider on the day of the Tour. It must be paid before the start of the Tour on site directly to the Tour Provider, in EUR or in local currency, by the payment methods the Tour Provider accepts. If payment is made in local currency, the Tour Provider is solely responsible for currency conversion and applying the applicable local exchange rate. If required, the User can request an invoice for this payment directly from the Tour Provider.
5.5. In the checkout area of the TourBookers Platform the User is informed of the amount payable, "Total payment amount (incl. VAT)", for the desired Tour. If the User's shopping cart contains more than one Tour, the individual amounts of "Due now (Security Deposit incl. VAT)" for the various Tours are added up to the amount "Total payment amount (incl. VAT)". By clicking the "Continue" button on the PayPal store page, the User submits a binding contractual offer to the tourist provider for the desired Tour and the amount payable is authorised. If the Tour Provider confirms the User's Tour booking request, the authorised amount payable is charged and the payment is made. If the Tour Provider rejects the User's Tour booking request, the authorised amount payable is released and the payment is cancelled.
5.6. The User can cancel their Tour booking request on the TourBookers Platform under "My tours" free of charge before the Tour Provider has confirmed the Tour booking request ("Cancel tour booking request free of charge"). In this case the payment is cancelled and the Tour is not invoiced to the User. The User can cancel their Tour booking free of charge within the stated cancellation period ("Cancel tour booking free of charge"). In this case the Security Deposit is refunded in the following days by the selected payment method. If the User cancels their Tour booking outside the stated cancellation period ("Cancel tour booking (for a fee)") or does not appear for the Tour, the Security Deposit is not refunded. If the Tour Provider cancels the Tour, the Security Deposit paid is refunded in the following days by the selected payment method.
5.7. The User must enter the correct payment information and update it immediately in the event of changes by notifying TourBookers customer service at info@tourbookers.com. TourBookers GmbH may reject the payment method stated by the User. The User is informed during the ordering process of the permitted payment methods for the respective Tour.
5.8. By authorising the payment, the User agrees that their payment information will be used for the collection of payments by TourBookers GmbH. TourBookers GmbH reserves the right to make the use of the payment function of TourBookers GmbH subject to a check of the User's creditworthiness.
6. Availability of the TourBookers Platform, third-party content, no guarantee
6.1. There is no claim against TourBookers GmbH to availability, quality, service functions or technical support for the TourBookers Platform. TourBookers GmbH may redesign, reduce or suspend the TourBookers Platform at any time at its own discretion. Existing agreements of the User with a Tour Provider, as well as the performance of those agreements, remain unaffected by these changes.
6.2. TourBookers GmbH gives no express or implied warranties as to the availability of the TourBookers Platform or its functions, or that the TourBookers Platform and the infrastructure on which it runs are free of viruses and other harmful software. Furthermore, TourBookers GmbH does not warrant that the information available on the TourBookers Platform has not been altered by technical defects or by unauthorised third parties.
6.3. TourBookers GmbH gives no guarantee or warranty for the accuracy or completeness of the data provided by third parties (for example Tour Providers).
6.4. TourBookers GmbH assumes no responsibility for third-party content (including all Tours of Tour Providers available for booking and information on those Tours) available via the TourBookers Platform, nor for content that is connected with the TourBookers Platform or linked or referred to from it. TourBookers GmbH does not recommend or endorse such content and assumes no liability for it. If you believe that there is illegal content on the TourBookers Platform, please send an email to info@tourbookers.com.
6.5. Where TourBookers GmbH refers to third-party websites, you use those websites at your own risk. We recommend reading the policies of those websites and checking how those websites may process personal data relating to you.
7. Liability of TourBookers GmbH
7.1. Unless TourBookers GmbH has assumed a contractual obligation by express agreement with the User, TourBookers GmbH is not liable for the performance or the conclusion of a tourist service contract by the Tour Provider.
7.2. Unless expressly declared or agreed by TourBookers GmbH, TourBookers GmbH is liable neither for defects in the provision of the Tour by the Tour Provider nor for personal injury or material damage incurred by the User in connection with the Tour provided by the Tour Provider.
7.3. Any liability of TourBookers GmbH for damages attributable to injury to body, life or health resulting from a culpable breach by TourBookers GmbH, its legal representatives or its vicarious agents in the brokerage of contracts for Tours remains unaffected.
7.4. Any liability of TourBookers GmbH for the breach of a key obligation which must be fulfilled to enable the proper performance of the brokerage contract, or the breach of which would jeopardise the fulfilment of the contractual purpose, or for other damage inflicted on the User through a grossly negligent breach of duty by TourBookers GmbH or an intentional or grossly negligent breach of duty by a legal representative or vicarious agent of TourBookers GmbH, remains unaffected.
7.5. In the case of gross negligence, TourBookers GmbH is liable only for the breach of a material contractual obligation and only for foreseeable and typical damage. Material contractual obligations are obligations which must be fulfilled to enable the proper performance of the contract and on the fulfilment of which the User may regularly rely.
7.6. TourBookers GmbH assumes no responsibility for third-party content (including activities available for Tour booking requests and information on such activities) available via the TourBookers Platform, nor for content that is connected with the TourBookers Platform or linked or referred to from it. TourBookers GmbH does not recommend or endorse such content and assumes no liability for it. Where TourBookers GmbH refers to third-party websites, you use those websites at your own risk. TourBookers GmbH recommends reading the policies of those websites and checking how those websites may process personal data.
7.7. Limitations of liability do not apply within the scope of the guarantees given, in the event of injury to body, life or health, or to claims under the Product Liability Act.
8. Data protection
8.1. TourBookers GmbH collects and uses personal data of Users to the extent necessary for the operation of the TourBookers Platform and for the conclusion and performance of the tourist service contract between the User and the Tour Provider.
8.2. Where TourBookers GmbH is involved in the communication in connection with the tourist service contract between the User and the respective Tour Provider, it transfers the necessary data or that agreement to the respective Tour Provider. That Tour Provider processes and uses the data in order to initiate, conclude and perform the contract on its own responsibility. The identity of the respective Tour Provider can be seen in the booking dialogue.

9. Applicable law and place of jurisdiction
9.1. The use of the website of TourBookers GmbH, of the TourBookers Platform and any contractual relationships between the User and TourBookers GmbH are governed by the laws of the Federal Republic of Germany. If the User is a natural person and is not located in Germany at the time of using the TourBookers Platform, the mandatory consumer protection law of the User's country of residence remains applicable.
9.2. The exclusive place of jurisdiction for all disputes arising from or in connection with the use of the website of TourBookers GmbH is Munich, if the User is a merchant under the German Commercial Code, a legal entity under public law or a special public fund, or if the User has no general place of jurisdiction in the Federal Republic of Germany.
10. Miscellaneous
10.1. Should provisions of these general terms and conditions be or become invalid, the validity of the remaining provisions is not affected thereby.
